Throughout these Terms of Service, the terms “Caledonian Fine Art”, “we”, “us” and “our” refer to Artline Group Ltd, trading as Caledonian Fine Art.

These Terms of Service explain the terms on which you may use our website and purchase products from us.

Our Privacy Policy, Refund Policy and any other policies displayed on our website also apply when you use our website or place an order.

Please read these Terms of Service carefully before using our website or purchasing from us. By using our website or placing an order, you agree to these Terms.

Nothing in these Terms affects your statutory rights as a consumer.

SECTION 1: USING OUR WEBSITE

You may use our website for lawful personal and non-commercial purposes.

You must not use our website:

• For any unlawful or fraudulent purpose
• To interfere with the operation or security of the website
• To introduce viruses, malware or other harmful material
• To attempt to gain unauthorised access to our website or systems
• To copy, scrape or extract website content for commercial use without our written permission
• To infringe our intellectual property rights or the rights of another person
• To submit false, misleading, abusive or unlawful information

We may suspend or restrict access to the website where reasonably necessary to protect our business, customers, systems or intellectual property.

SECTION 2: YOUR INFORMATION

When placing an order, you must provide accurate, complete and current information, including your name, email address, billing information and delivery address.

You are responsible for checking your order details before submitting your order.

Please contact us as soon as possible if you notice an error in your order details. We cannot guarantee that changes can be made after an order has entered production or been dispatched.

SECTION 3: OUR ARTWORK AND PRODUCTS

We take reasonable care to ensure that product descriptions, photographs, dimensions, colours and other information displayed on our website are accurate.

However, the appearance of colours may vary slightly depending on your screen, device settings, lighting and display calibration.

Framed prints, mounts and other physical products may also have small variations resulting from the materials and production process. Original paintings and hand-finished artworks may contain natural variations that form part of the artwork.

Unless stated otherwise, dimensions shown on product pages are approximate. Please read the individual product description and sizing information carefully before ordering.

Any screen or production variation will not affect your legal right to receive goods that are as described, of satisfactory quality and fit for their intended purpose.

We may update product descriptions, specifications or availability from time to time. Changes will not affect an order that we have already accepted unless the change is required by law or agreed with you.

SECTION 4: PLACING AN ORDER

When you place an order through our website, you are offering to purchase the products in your basket.

After placing your order, you will normally receive an order acknowledgement by email. This acknowledges that we have received your order but does not necessarily mean that we have accepted it.

A contract between you and us is formed when we send you confirmation that your order has been accepted or dispatched.

We may decline an order before accepting it where, for example:

• A product is unavailable
• We cannot authorise or verify payment
• We cannot deliver to the address provided
• We reasonably suspect fraud or unauthorised payment
• There is an obvious error in the price or product information
• The order breaches these Terms or an applicable legal requirement

If we decline an order after taking payment, we will refund the amount paid using the original payment method.

Products are sold for personal or household use unless we have agreed otherwise in writing. Products must not be purchased for unauthorised commercial resale.

SECTION 5: PRICES AND PAYMENT

Prices are shown in pounds sterling and include VAT where applicable.

Any delivery charge will be clearly displayed before you complete your order.

Prices, promotions and discount codes may change from time to time. The price charged will be the price displayed when your order is submitted, subject to the correction of an obvious pricing error before we accept the order.

Promotional offers may have additional terms, including expiry dates, minimum spending requirements and exclusions. Only one discount code may be used per order unless we state otherwise.

You must be authorised to use the payment method provided. Payment must be successfully authorised before we can process and accept your order.

SECTION 6: CANCELLING OR CHANGING AN ORDER

Please contact us as quickly as possible if you wish to cancel or change an order.

Many of our products are prepared or produced after an order is placed. Once production has started, we may be unable to stop or amend the order before dispatch.

This does not remove any cancellation or return rights that you have under our Refund Policy or applicable consumer law.

SECTION 7: DELIVERY

Available delivery destinations, delivery charges and estimated delivery times will be shown on our website or during checkout.

Delivery dates are estimates unless we have expressly agreed a guaranteed date with you.

We will take reasonable steps to deliver your order within the estimated timeframe. If a significant delay occurs, we will contact you where possible and explain the available options.

Unless a different delivery period has been agreed, we will deliver your order within 30 days of the contract being formed.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed delivery caused by incorrect or incomplete address information supplied by you.

If no one is available to receive the delivery, the courier may leave instructions, attempt redelivery or deliver the parcel to a suitable collection point.

Responsibility for the artwork remains with us until it is delivered into your physical possession, or into the physical possession of a person identified by you to receive it.

Ownership of the product passes to you once we have received full payment.

SECTION 8: NO QUIBBLE 30-DAY RETURNS

We want you to be completely happy with your artwork.

If you change your mind, you may return your order within 30 days of receiving it, subject to the conditions in our Refund Policy.

To arrange a return, email sales@caledonianfineart.com before sending the artwork back. We will provide return instructions.

For change-of-mind returns:

• The cost of returning the order is your responsibility
• We recommend using a tracked and appropriately insured service
• The artwork should be returned in its original condition
• The original packaging should be used wherever reasonably possible
• You are responsible for the artwork until it reaches us

You may examine the artwork as you would reasonably be able to examine it in a shop. Where permitted by law, we may make a reasonable deduction from a refund if the artwork has been handled beyond what is necessary to establish its nature, characteristics and condition, and its value has been reduced as a result.

Personalised, commissioned or specially customised artwork may not qualify for change-of-mind cancellation where the law permits this exception. This does not affect your rights where an item is faulty, damaged, misdescribed or incorrect.

Our voluntary 30-day returns promise operates alongside your statutory cancellation and consumer rights and does not replace or restrict them.

SECTION 9: DAMAGED, DEFECTIVE OR INCORRECT ITEMS

Please inspect your order after delivery.

If your artwork arrives damaged, defective or incorrect, contact us as soon as reasonably possible at sales@caledonianfineart.com.

Please include:

• Your order number
• A description of the problem
• Photographs showing the artwork, packaging and any visible damage, where reasonably possible

Photographs help us assess the problem and arrange a resolution quickly.

Where the artwork is damaged, defective, misdescribed or incorrect, we will provide an appropriate remedy in accordance with your legal rights. Depending on the circumstances and your preference, this may include a replacement, refund, repair or price reduction.

We will cover reasonable return costs where an item needs to be returned because it is damaged, defective, misdescribed or incorrect.

Nothing in this section limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.

SECTION 10: REFUNDS

For an approved change-of-mind return, we will refund the amount due to your original payment method after receiving and inspecting the returned artwork, or after receiving acceptable evidence that it has been returned where applicable.

Refunds will be issued without undue delay and within the period required by law.

Where required by law, the refund will include the standard delivery charge originally paid. Additional delivery costs chosen by you, such as an upgraded or express delivery service, may not be refundable beyond the cost of our standard delivery option.

Your bank, card issuer or payment provider may take several working days to show the refund in your account after we have processed it.

Refunds for damaged, defective, misdescribed or incorrect products will be handled in accordance with your statutory rights.

SECTION 11: PRODUCT AVAILABILITY

All products are subject to availability.

We may withdraw or discontinue products at any time. This will not affect an order we have already accepted unless we are unable to supply the product.

If we cannot supply an accepted order, we will contact you as soon as reasonably possible and offer an appropriate alternative where available or provide a full refund.

SECTION 12: INTELLECTUAL PROPERTY

All content on the Caledonian Fine Art website, including artwork images, photographs, artist names and profiles, text, graphics, logos, branding, videos, product descriptions, website design and other materials, is owned by or licensed to Artline Group Ltd.

This content is protected by copyright, trademark and other intellectual property laws.

Purchasing an artwork or print does not transfer copyright or any other intellectual property rights in the image or artwork to you.

You may not, without our prior written permission:

• Copy, reproduce or republish our artwork images or website content
• Create or sell reproductions or derivative products
• Use our content for commercial advertising or resale
• Remove copyright, watermark or ownership information
• Use our artist names, logos or branding in a way that suggests affiliation or endorsement

You may share links to our publicly available website pages for personal, non-commercial purposes, provided the material is not altered or presented misleadingly.

All rights not expressly granted are reserved.

SECTION 13: REVIEWS, PHOTOGRAPHS AND FEEDBACK

You may choose to submit reviews, comments, photographs or other feedback about your purchase.

You confirm that any material you submit:

• Is accurate and reflects your genuine experience
• Does not infringe another person’s rights
• Does not contain unlawful, abusive, defamatory or misleading content
• Does not contain malicious software or promotional spam

By submitting photographs, reviews or feedback for publication, you grant us a non-exclusive, royalty-free licence to display, reproduce and use that material in connection with our website, customer service and marketing.

You retain ownership of your original material.

We may moderate or remove submitted content where we reasonably believe it is unlawful, misleading, offensive, irrelevant or infringes another person’s rights.

SECTION 14: THIRD-PARTY SERVICES AND LINKS

Our website may use services provided by third parties, including payment providers, delivery companies, review platforms, website applications and embedded content.

Your use of certain third-party services may also be subject to the provider’s own terms and privacy policy.

Our website may contain links to websites that we do not operate. We are not responsible for the content, availability or practices of those external websites.

Nothing in this section excludes responsibility that we have under applicable law for third parties acting on our behalf in fulfilling your order.

SECTION 15: SHOPIFY

Our online store is hosted and supported by Shopify.

Shopify provides the ecommerce platform that enables us to display products and process orders. However, purchases made through the Caledonian Fine Art store are made directly from Artline Group Ltd, trading as Caledonian Fine Art.

Shopify is not the seller of our artwork and is not responsible for fulfilling your order, handling returns or resolving product complaints.

Information may be processed by Shopify and our other service providers as explained in our Privacy Policy.

SECTION 16: OUR RESPONSIBILITY TO YOU

We are responsible for losses that you suffer where those losses are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

A loss is foreseeable where it was obvious that it might occur or where both you and we knew that it might occur when the contract was formed.

We are not responsible for losses that are:

• Not caused by a breach on our part
• Not reasonably foreseeable
• Business losses arising from a purchase made mainly for commercial purposes

Nothing in these Terms excludes or limits our responsibility where it would be unlawful to do so, including responsibility for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Breach of your statutory rights relating to the products
• Any other liability that cannot legally be excluded or limited

SECTION 17: EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for a delay or failure caused by an event outside our reasonable control, provided that we take reasonable steps to minimise the effect of the event and contact you where the delay is likely to be significant.

Such events may include severe weather, transport disruption, postal or courier disruption, industrial action, fire, flood, natural disaster, interruption to utilities or communications, or government action.

If an event outside our reasonable control causes a substantial delay, you may have the right to cancel the affected order and receive a refund for products not supplied.

SECTION 18: PRIVACY

We collect and use personal information in accordance with our Privacy Policy.

Because our store is hosted through Shopify and uses third-party payment, delivery and website services, personal information may be shared with service providers where necessary to operate the website, process payments, fulfil orders, prevent fraud and provide customer support.

Please read our Privacy Policy for further information about how personal information is collected, used, stored and protected.

SECTION 19: SUSPENSION AND TERMINATION

We may suspend or terminate your access to parts of our website where we reasonably believe that:

• You have seriously or repeatedly breached these Terms
• Your activity is fraudulent or unlawful
• Your activity poses a security risk
• Suspension is necessary to protect our website, business or other users

Termination of website access does not affect rights and obligations relating to an order already accepted unless the order itself is lawfully cancelled.

SECTION 20: CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, website, services or legal obligations.

The version applying to your purchase will normally be the version in force when you placed your order.

Any updated Terms will be published on this page with a revised “Last updated” date.

SECTION 21: SEVERABILITY

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed only to the extent necessary.

The remaining sections will continue to apply.

SECTION 22: NO WAIVER

If we delay exercising a right or remedy under these Terms, this does not mean that we have waived that right or remedy.

A waiver will only apply where it has been clearly confirmed in writing.

SECTION 23: GOVERNING LAW AND DISPUTES

These Terms and any contract between you and us are governed by Scots law.

We encourage you to contact us first if you have a complaint so that we can try to resolve the matter directly.

If you live in Scotland, legal proceedings may be brought in the Scottish courts.

If you live elsewhere in the United Kingdom, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom where you live.

Nothing in this section limits any mandatory consumer protection available to you under the law of the country in which you normally live.
